C. These policies are a part of our Terms, so be sure to read the ones that are relevant for you. Of course, you will still want to read the rest of this document because it applies to everyone!
3. Your Privacy
B. Both Crafters Booty and sellers process members’ personal information (for example, buyer name, email address, and shipping address) and are therefore considered separate and independent data controllers of buyers’ personal information under EU law. That means that each party is responsible for the personal information it processes in providing the Services. For example, if a seller accidentally discloses a buyer’s name and email address when fulfilling another buyer’s order, the seller, not Crafters Booty, will be responsible for that unauthorized disclosure.
C. If, however, Crafters Booty and sellers are found to be joint data controllers of buyers’ personal information, and if Crafters Booty is sued, fined, or otherwise incurs expenses because of something that you did as a joint data controller of buyer personal information, you agree to indemnify Crafters Booty for the expenses it occurs in connection with your processing of buyer personal information. C. You release Crafters Booty from any claims, demands, and damages arising out of disputes with other users or parties.
11. Disputes with Crafters Booty
A. The Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live, but if you live outside of the United States, you may be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection law.
B. You and Crafters Booty agree that any dispute or claim arising from or relating to the Terms shall be finally settled by final and binding arbitration, using the English language, administered by the American Arbitration Association (the “AAA”) under its Consumer Arbitration Rules (the “AAA Rules”) then in effect (those rules are deemed to be incorporated by reference into this section, and as of the date of these Terms), unless otherwise required by law. Arbitration, including threshold questions of arbitrability of the dispute, will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis — class arbitrations and class actions are not permitted. You understand that by agreeing to the Terms, you and Crafters Booty are each waiving the right to trial by jury or to participate in a class action or class arbitration. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator. You may instead assert your claim in “small claims” court, but only if your claim qualifies, your claim remains in such court, and your claim remains on an individual, non-representative, and non-class basis.
C. Payment for any and all reasonable AAA filing, administrative, and arbitrator fees will be in accordance with the Consumer Arbitration Rules. If the value of your claim does not exceed $10,000 USD, Crafters Booty will pay for the reasonable filing, administrative, and arbitrator fees associated with the arbitration, unless the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for an improper purpose.
D. We are based in Florida, so any legal action against Crafters Booty related to our Services must be filed and take place in Alachua County, Florida. For all actions under the AAA Rules, the proceedings may be filed where your residence is, or in Alachua County, Florida, and any in-person, hearings will be conducted at a location that is reasonably convenient to both parties taking into account their ability to travel and other pertinent circumstances. For any actions not subject to arbitration, you and Crafters Booty agree to submit to the personal jurisdiction of a state or federal court located in Alachua County, Florida if your contract is with Crafters Booty.
E. If you are a government agent or entity in the United States using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the United States (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Florida.
F. If we make any changes to this “Disputes with Crafters Booty” section after the date you last accepted the Terms, those changes will not apply to any claims filed in a legal proceeding against Crafters Booty prior to the date the changes became effective. Crafters Booty will notify you of substantive changes to the “Disputes with Crafters Booty” section at least 30 days prior to the date the change will become effective. If you do not agree to the modified terms, you may send Crafters Booty a written notification (including email) or close your account within those 30 days. By rejecting a modified term or permanently closing your account, you agree to arbitrate any disputes between you and Crafters Booty in accordance with the provisions of this “Disputes with Crafters Booty” section as of the date you last accepted the Terms, including any changes made prior to your rejection. If you reopen your closed account or create a new account, you agree to be bound by the current version of the Terms.
12. Changes to the Terms
A. We may update these Terms at any time. If we believe that the changes are material, we will let you know by posting the changes through the Services about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes unless otherwise specified. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.
13. Some Finer Legal Points
A. The Terms, including all of the policies that make up the Terms, supersedes any other agreement between you and Crafters Booty regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.

A. We expect our sellers to provide a high level of customer service. By selling on Crafters Booty, you agree to: Honor your shipping and processing times. Sellers are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for shipping times vary by country. Read more in our Shipping Policy. Respond to Conversations in a timely manner. Honor the commitments you make in your shop policies. Resolve disagreements or disputes directly with the buyer. If you are unable to complete an order, you must notify the buyer and cancel the order and process a refund to the buyer. As a seller, you must provide great customer service and maintain trust with your buyers.
9. Responding to Requests for Cancellations, Returns, and Exchanges
A. Please be aware that in addition to this policy, each country has its own laws surrounding shipping, cancellations, returns, and exchanges. Please familiarize yourself with the laws of your own country and those of your buyers’ countries.
B. If you are unable to complete a transaction, you must notify the buyer via Crafters Booty Conversations and cancel the transaction. If the buyer already submitted payment, you must issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises.
C. Buyers in the European Union (EU) may be entitled to a 14-day “right of withdrawal” after receiving an item, during which they may return an item for any reason. The details of this right vary by EU member state. The right of withdrawal does not apply to custom items or certain perishable goods. Rights with respect to digital items vary by EU member state.
D. We ask buyers to contact sellers directly and attempt to resolve any outstanding issues. For this reason, it is important that you fill out your shop policies and regularly respond to Conversations from your buyers.

F. An item is not as described if the buyer can demonstrate that it is significantly different from your listing description or your photos. The following are examples of not as described cases: The item received is a different color, model, version, or size. The item has a different design or material. The seller failed to disclose that an item is damaged or is missing parts. The buyer received the incorrect quantity of items (e.g., the buyer purchased three items but only received two). The item was advertised as authentic but is not authentic. The condition of the item is misrepresented (e.g., the item is described as new but is used).
10. Fees and Payments
A. In an effort to limit the amount of fees imposed on sellers, Crafters Booty will only collect fees in the amount charged by the third-party payment processors (PayPal, and Stripe). Both PayPal and Stripe currently charge $0.30 per transaction plus 2.9% of the total transfer amount. In addition to the standard fees listed above, additional fees may be assessed for foreign transactions or currency conversions.
B. All taxes owed at the end of the year will be the responsibility of the seller to file and pay with the appropriate agencies. As we do not collect and maintain the tax payed by the customer we are unable to file on your behalf. The system we use however will show you how much tax you were payed by any members in a given state.
C. As the site (Crafters Booty) matures, the above-mentioned fees and tax collection policy may change. All merchants will be given an opportunity for input when these changes come about.

Below you will find some of the reasons we prohibit certain types of items or services on Crafters Booty. Some items present legal risks to our community; others are inconsistent with our values, are harmful to our members, or simply are not in the spirit of our site. This policy explains what is prohibited or restricted on Crafters Booty.
The following types of items are prohibited or restricted on Crafters Booty:
Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
Animal Products and Human Remains
Dangerous Items: Hazardous Materials, Recalled Items, and Weapons
Hate Items: Items that Promote, Support, or Glorify Hatred
Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
Internationally Regulated Items
Pornography and Mature Content
Violent Items: Items that Promote, Support, or Glorify Violence
In order to help provide clarity and insight into our policy making process, we have included the rationale behind our decisions and details about how they will be enforced. We reserve the right to remove listings that we determine are not within the spirit of Crafters Booty. Violating this policy may result in the member’s selling privileges being suspended and/or terminated.
1. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
Alcohol and drugs are prohibited on Crafters Booty. These substances face serious legal restrictions and in many cases are considered controlled substances under applicable law. Our policy also applies to other substances that have or are claimed to have an intoxicating or healing effect. Possible legal restrictions aside, these substances are not in the spirit of our site.
Restrictions on descriptions of purported health benefits:
A medical drug claim is a statement or suggestion that an item prevents, heals, or treats a medical condition or disease. Medical drug claims are subject to varying degrees of regulation. If you make claims about the purported health benefits of an item for sale on Crafters Booty, we urge you to speak with a qualified expert about which regulations apply to you. It is your responsibility to know and comply with all laws and regulations that apply to the items you sell.
Crafters Booty prohibits certain medical drug claims based on our values, such as claims likely to deceive or pose an unreasonable risk to our community. Crafters Booty may remove claims that we deem to be inappropriate, excessive, or otherwise unsuitable for our marketplace. We also remove content that promotes prohibited medical claims, such as anti-vaccine items. If Crafters Booty receives proper notice from a legal authority, we may remove an item.
2. Animal Products and Human Remains
Certain animal products are highly regulated and prohibited on Crafters Booty due to the risk of harm to live, companion, or endangered animals.
Items created using any endangered or threatened animal species. We define these as animal species designated as threatened or endangered by the US Endangered Species Act or listed in Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).
Items made from cat and dog parts or pelts as defined by US Federal Law.
Ivory or bones from ivory-producing animals, including tusks, elk ivory, fossilized ivory, and wooly mammoth ivory.
Items made from human remains or products from the human body, except for teeth, fingernails, and hair.
We expect all of our members to follow their local laws. If you are shipping items across international borders you should also consult CITES for specific information about importing and exporting species that may be threatened. If you sell products containing feathers, you should also consult the Migratory Bird Treaty Act.
3. Dangerous Items: Hazardous Materials, Recalled Items, and Weapons
For safety and legal reasons, we prohibit certain dangerous items from our marketplace.
Due to the potential harm caused by hazardous materials, as well as complex legal and shipping regulations surrounding such materials, hazardous materials are prohibited on Crafters Booty.
While not exhaustive, the following materials are examples of prohibited hazardous materials:
Explosives (fireworks or sparklers)
Toxic substances (such as poisons)
Recalled Items or Items that Present Unreasonable Risk of Harm
Items that have been recalled by governments or manufacturers are prohibited from being sold on Crafters Booty. A few examples of items that have been recalled are certain Strollers, Car Seats, and lawn darts.
Items that present an unreasonable risk of harm are prohibited, even if they have not been the subject of a recall. This would include, for example, items that present a choking hazard. We generally rely on information from various government agencies to identify these items.
When in doubt, it is safe to assume that we will not allow any item intended to be used as a weapon to inflict harm. The following items are generally not allowed on Crafters Booty:
Guns, knives, or other blatant weapons.
Imitation firearms and weapons that look real or are prohibited by US law
4. Hate Items: Items that Promote, Support, or Glorify Hatred
We have worked hard to make Crafters Booty a community where people of all backgrounds, nationalities, religions, political affiliations, and even different types of artistic taste and humor feel welcome. However, please keep in mind that what is offensive to one is not necessarily offensive to others.
Crafters Booty does not allow items or listings that promote, support or glorify hatred toward people based upon: race, ethnicity, national origin, religion, gender, gender identity, disability, or sexual orientation (collectively, “protected groups”). We also prohibit items or content that promotes organizations or people with such views.
The following items are not allowed on Crafters Booty:
Items that support or commemorate current or historical hate groups, including propaganda or collectibles. Examples of hate groups include Nazi or Neo-Nazi groups, Ku Klux Klan (KKK) groups, white supremacist groups, misogynist groups, or groups that advocate anti-gay, anti-immigrant, or Holocaust denial agendas.
Items that contain racial slurs or derogatory terms in reference to protected groups.
5. Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
We respect the law and expect Crafters Booty sellers to respect the law as well.
Illegal items, items that promote illegal activity, and stolen items are not allowed on Crafters Booty. Neither are certain items that are subject to complex legal regulations or registration systems. Because Crafters Booty is a global marketplace, it is important to abide by the laws of the markets in which you are selling. What is legal in one country may be illegal in another. All forms of illegal activity are strictly prohibited. Listings may not facilitate or promote illegal acts.
Counterfeit or unauthorized items are prohibited on Crafters Booty. We consider counterfeit or unauthorized goods to be items that imitate an authentic good, particularly by using a brand’s name, logo, or protected design without the brand owner’s consent.
Additionally, due to complex legal restrictions that vary by location, Crafters Booty does not permit the sale of real estate, housing, or motor vehicles (for example: automobiles, motorcycles, boats, travel trailers, etc.).
We require sellers to follow all applicable laws for the items they list. Examples of items that may be subject to regulation include Native American crafts, plants and seeds, and food products.
6. Internationally Regulated Items
Crafters Booty provides a direct connection between buyers and sellers around the world through our marketplace. If you buy or sell an item from another country, or if you enter into a transaction with someone across international borders, you are responsible for complying with laws and regulations of the country of destination as well as your local laws. You might be prohibited from exporting or importing certain items under international laws and regulations. Some transactions may require licenses, permits, or other documentation. If you have questions about how to comply with the law, we recommend that you speak to a qualified professional.
When you use Crafters Booty’s services, you are also responsible for complying with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control (“OFAC”) of the US Department of the Treasury.
Crafters Booty reserves the right to request that sellers provide additional information, disclose an item’s country of origin in a listing, or take other steps to meet compliance obligations.
You should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block some transactions as part of their own compliance programs. Crafters Booty has no authority or control over the independent decision-making of these providers.
7. Pornography and Mature Content
As a creative community, we tend to be fairly liberal about what we allow on Crafters Booty, but we draw the line at pornography. Beyond that, we restrict mature content so that people who are offended by this kind of material do not have to see it. If you are selling mature content, we ask that you be respectful of differing sensibilities.
Pornography of any sort is prohibited on Crafters Booty, whereas mature content is restricted.
Although pornography can be difficult to define, an item generally qualifies as pornography when it contains extreme or explicit version of sexual content.
8. Violent Items: Items that Promote, Support, or Glorify Violence
We want Crafters Booty to be a safe place for everyone. While violent content can be a legitimate part of historical, educational, or artistic expression, it should never be used to promote or glorify violent acts against others.
We do not allow items or listings that promote, support or glorify acts of violence or harm towards self or others, including credible threats of harm.
Intellectual Property Policy
As a venue for artists, designers, and makers, Crafters Booty takes intellectual property rights very seriously. We comply with intellectual property laws and industry best practices in order to maintain the integrity of our creative marketplace. This Intellectual Property Policy explains how we address allegations of infringement, how authorized parties can submit proper notices of infringement regarding content on our marketplace, and how Crafters Booty sellers can respond when their listings or shops are affected by a notice.

2. Notices of Intellectual Property Infringement
3. Counter Notices
4. Repeat Infringement
5. Notice Withdrawals
1. Crafters Booty’s Role
A. Crafters Booty is a marketplace comprised of individual third¬-party sellers who run their own shops, create their own policies, and are responsible for their inventory, shipments, and complying with the law. We provide a venue, but Crafters Booty does not manufacture goods, hold inventory, or ship items on behalf of our sellers. The content uploaded on Crafters Booty’s marketplace is generated by independent sellers who are not employees, agents, or representatives of Crafters Booty. Sellers are responsible for ensuring they have all necessary rights to their content and that they are not infringing or violating any third party’s rights by posting it.
C. Crafters Booty can’t speak on behalf of intellectual property owners, nor is Crafters Booty in a position to offer legal advice or make legal determinations whether a shop’s content infringes someone else’s intellectual property. Crafters Booty will remove material cited for alleged intellectual property infringement when provided with a proper notice.
2. Notices of Intellectual Property Infringement
A. Crafters Booty strives to respond quickly when we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When Crafters Booty removes or disables access in response to a notice, Crafters Booty makes a reasonable attempt to contact the affected member, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about how to submit a counter notice. Crafters Booty may also provide a copy of the infringement notice, including the name and email address of the reporting party, to the affected member.
B. Please email firstname.lastname@example.org if you believe your copyright material has been infringed. Include a detailed description of why you believe your material has been copied and any supporting documentation if it exists. Additionally include all relevant contact information. Providing us with the information requested above will speed the process to remedy any infringement on your copyright material.
C. Crafters Booty may request additional information before processing a notice, such as identity verification of the reporting party or documentation regarding the claimed right. Crafters Booty may reject notices or counter notices that contain information we believe is false, fraudulent, incomplete, or otherwise submitted in bad faith. Crafters Booty also reserves the right to take action against abusers of this policy.
3. Counter Notice
A. In accordance with the Digital Millennium Copyright Act (DMCA), Crafters Booty accepts counter notices for copyright notices only. When Crafters Booty receives a DMCA counter notice, we will provide a copy of the counter notice to the original complaining party. The removed material may be replaced or access to it may be restored 10 business days after the counter notice is processed, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Crafters Booty of this action.
4. Repeat Infringement
5. Notice Withdrawals
A. Crafters Booty only accepts withdrawals of infringement notices directly from the intellectual property owner or authorized representative who submitted the claim. The withdrawal must clearly state that it is a formal withdrawal and sufficiently identify the member and/or material (such as by providing the username, shop name, and Crafters Booty listing URLs). B. Once Crafters Booty receives a formal withdrawal of a notice of infringement, Crafters Booty makes reasonable attempts to contact both parties involved to confirm receipt from the party submitting the withdrawal and to inform the member affected by the withdrawal. Please note that infringement matters are reviewed on a case-by-case basis, and withdrawals do not guarantee changes to a member’s shop status.

Session cookies expire and delete themselves automatically in a short period of time, like after you leave the Site or when you close your web browser. Persistent cookies remember certain information about your preferences for viewing the site, and allow Crafters Booty to recognize you each time you return. Persistent cookies are stored on your browser cache or mobile device until you choose to delete them, and otherwise typically delete themselves at expiration. Third-party cookies are placed by someone other than Crafters Booty, and may gather browsing activity across multiple websites and across multiple sessions. They are usually a type of persistent cookie and are stored until you delete them or they expire based on the time period set in each third-party cookie.
